Employment Termination Policy

Weekly hire employees may be terminated with notice as prescribed by the Work Place Relations Act 1996, or by payment in lieu of notice. Employees will be required to provide the same notice and where such notice is not provided the employer may withhold wages. This will not effect the right of the company to dismiss any employee without notice for theft, malingering, inefficiency, neglect of duty, violence, intimidation and misconduct, and in such cases wages will be paid up to the time of dismissal only.

Loss of Validation of Licences / Certificates

  1. Employees have a duty to notify the company in the event of cancellation or suspension of licences and/or certification required in the performance of their duties.

  2. Should either a licence or certification held by an employee be cancelled or suspended and the employee has notified the company in accordance with sub clause 1 above, all possible alternate employment options will be examined. Alternate employment options will be discussed with either/both of the elected union delegates.

Summary (INSTANT) Dismissal

If an employee is guilty of conduct or behaviour, which warrants summary dismissal, the Company shall not be required to either give notice or to make payment in lieu thereof.
